• TERMS OF SERVICES •
General Information
♦ Ordering a commission from me means you've agreed and accepted the T.O.S.
♦ I, the arist, hold every rights to the artwork. (which means to promote myself).
♦ English is not my first language, so Avoid using difficult words.
♦ I will only do small changes from minor errors. I will not Re-do an entire commission.
♦ You can request a sketch WIP if you'd like for you to see the progress if any changes should be made.PAYMENT
♦ Payment will be made through paypal and with the currency of USD.
♦ I expect the payment within 7 days, if there will be delays, we can properly discuss it.PAYMENT PLAN
♦ Payment must be sent within 24 hours of receiving invoice.
- For Upfront Payment plans :
• upfront payment for 150$ Below = $30
• upfront payment for 150$ above = $50
♦ You don't own the character until you've fully payed the payment.PAYMENT PLAN POLICY
♦ Payment plans must be completed within 3 months (unless an extension is granted). If payments or updates are not received within our agreed timeline, I reserve the right to cancel the transaction and resell the adoptable.
♦ In such cases, the initial deposit paid to reserve the adoptable is non-refundable as compensation for the time and cost of holding the design. Remaining payments will be partially refunded, with the exact amount to be discussed.
♦ This policy ensures fairness and respect for the artist’s time and effort.WORK SPEED
♦ I will do my best to finish your commissioned piece as fast as i can, but due to personal issues that happen in my daily life- there will be delays.
♦ Commission may take up to 1 week to 4 months. If there are delays, I Will notify you.REFUND
♦ You have no rights to cancel or demand a refund to the artist under any circumstances once you have sent the payment unless there's a good reason for it. (serious financial problems).
♦ If you file a charge back you will be banned for buying future commissions from me and will be blocked. If i ever did commissions from you before, your right to every piece will be retracted.COMMERCIAL USE♦ For Commercial commissions, they might vary depending on the art piece. They are ranged to 2- 4x of the original price.
♦ Commissioned works and designs are for Personal Use (Non-Commercial Use) meaning you are not allowed to sell, reprint or make profit off my artworks.
♦ For Commercial use, please discuss with me prior or after purchasing. A Commercial License requires an additional payment of 100-150% for artworks or designs exceeding $150 USD. If the total is below $150 USD, the fee will vary between 100-400% depending on the art pieces and original sale price. Upon receiving payment for Commercial Use, all Commercial Rights for the artworks and/or designs will be handed over to the client.
♦ Client may create physical or digital products involved in but not limited to printing, stickers, webcomics, novels and website elements for Commercial and Non-Commercial use.
♦ Non-Commercial Use involves using my art/designs for videos, streaming, emojis, Vtubing for non-profit reasons and activities.
♦ Commercial Use involves using my art/designs for generating revenue through means such as selling digital/physical goods, advertising and streaming/video income.
• ADOPTABLE T.O.S •
⟡ General Rules ⟡
- Owning my design means you can make small changes / edits as long as the original design is still recognizable. Yes, you can also convert them to a closed species as long as both sides agreed. (Changing skin color is perfectly fine too!)
- All designs are for PERSONAL USE ONLY. Unless, Commercial use is purchased.
- My designs should not be used for NFT and AI.
- You are not allowed to sell the design higher than the original price (Unles there is a PAID extra art).
- Failure to acknowledge and listen to my rules will first result into a warning. If you were to abide the TOS one more, you will be blacklisted from owning my designs.⟡ Trade, Voucher / Gifted designs ⟡
- Once traded / gifted, the value turns to o. You can only charge for the commissioned piece from the design. However, if both sides traded for the same value, you can still re-sell the design for the same value.
- For vouchers, If someone pays OVER the original base price, you have to make it up to even their offer. Though, if they re-sell the Adoptable (base price) their value does not change. You cannot add value to the design from vouchers.⟡ Claiming ⟡
- Max 2 designs per buyer for batch posts (unless stated otherwise). but no limit for single adopts.⟡ Payment Timeframe ⟡
- New buyers have a maximum of 3 days hold and payment should be made within 48 hours after invoice has been sent.
- Regular buyers are entitled to have 7 days hold and can ask for a little more time to settle payment than what's agreed on the payment timeframe (48 hours after invoice.)
- If no payment is received within 48 hours, contact will be made to confirm that the invoice was received.
- If there is no response or payment 7 days after first contact, the claim will be automatically forfeited, and the invoice will be cancelled.⟡ Character rights: Personal vs Commercial ⟡
- Using designs for Vtubing, printing art, keychains, stickers, badges, etc. are okay as long as it's for personal use.
- If you are making profit from my designs, you must pay a commercial fee in order to proceed using them for marketing.
